THE LEGAL AID-SCHEME

If You are a person of limited means, you will probably be entitled to a cost-free proceeding under the legal aid-scheme. The benefit of a cost-free proceeding covers, fully or partially, the councellors compensation as well as trial fees. It includes the appointment of a public defender. In criminal cases the public defender can be granted already during the pretrial investigation. You have the right to appoint Your own legal counsel ! It is important for You to note that You have the right to appoint your own defence counselor. In Finland the public defender can also be a privately practicing lawyer. No sensible person accepts in a criminal case a public defender offered by the police, customs officials or the court. Therefore it is important for You to choose a defense councellor who really is ready to fight for Your rights and interests in the court. The law states the conditions under which a person is granted cost-free proceedings under the legal aid-scheme. Cost-free proceedings are granted by the court upon application but in order to apply, You need a recommendation from the legal aid office.
